The registration of an Industrial Design allows designers to obtain protection for the appearance of products that they have designed. Registrable designs must have features of shape, pattern, or ornamentation which are present in the product. These features in the product must be apparent to the eye. Registrable designs do not include methods or principles of construction which are more appropriately afforded protection under the Patents Act.
In accordance with a law passed in 2004, registration and certification of a design will grant the owner the right to use, make, and sell products under the registered design for a period of up to ten years.
