Plant Breeder's Rights

The Plant Breeder’s Rights Act 1994 provides plant breeders the opportunity to register in Australia new plant varieties which are distinct, uniform and stable. The registration of a new plant variety under the Act provides the breeder with an exclusive right to any of the following actions:

 

  • Propagate material of the registered plant variety
  • Produce and/or reproduce the material
  • Condition the material for the purpose of propagation
  • Offer the material for sale
  • Sell the material
  • Import the material
  • Export the material
  • Stock the material for any of the above actions
