Update on IP Australia’s Streamlined Extensions of Time Process

As part of its COVID-19 relief measures, IP Australia has announced that the streamlined process for requesting fee-free extensions of time of up to three months on a range of actions will be continued until 31 October 2020.

If a streamlined three-month extension of time has already been obtained by an Applicant for a patent, trade mark, or design and the Applicant finds that a further extension of time is needed due to the impact of the COVID-19 pandemic, then the Applicant may apply for an additional streamlined extension of time for up to a further three months.

IP Australia recognises that the continued Stage 4 restrictions in Victoria may be causing Applicants additional disruptions. If Applicants need more flexibility than the streamlined process for extensions of time offers, IP Australia is willing to discuss these circumstances and to explore how assistance may be provided.
